Not sure where else to ask...is there liability in gifting?

I have no intention to ever sell my soap or lip balm but I do want to give it as gifts. Its the only way I can justify the expense :D

My question is do I need any special insurance like sellers have in case I 'gift' it to the wrong person? Is there any liability involved?
 
It depends on who you give it to... Im no expert but I want to say you could still be liable since it is your product and you gave it to one of those people who look for lawsuits...but like if your giving it to your bro, mom, dad etc... I wouldnt really worry about it... I mean...we need willing guinea pigs to experiment on....

but I could be wrong so dont take my word as the 'end all'

I'll have to tell the hubs about the double duty bar soap can add to his manscape routine 8)

And I hope I wouldn't give it to anyone sue happy but you just never know...

A follow up question...I have a friend who has his own insurance agency and an uncle who is VP of a construction company. If they were to purchase soap from me at cost of materials and give as gifts to clients, that would probably and technically still fall under 'selling'???

Yeahhh that would definitely be an instance that youd want to have insurance, proper labeling etc... think about if they were to give the soap or whatever you are making to someone...which is a really nice gesture... but imagine if they give it to someone allergic to one of the ingredients or something similar... then that wraps their business up as well as yours (even though I know you had no intention to sell the stuff)...

its liability all the way around in that case ... so be careful :) Does your friend sell biz insurance? or could he write you up a custom policy? thatd be cool :)... I know the insurance really doesnt cost much..maybe like $100 a year... and any lawsuit will run you waaaaaaaaaaaaaaaaaaaaaaaaaaaaay more than that... so IMO its worth it if youll be gifting to large numbers of people/people you dont know or have anyone elses biz wrapped up in it too...

Kinda like with my massage therapy thing... I need insurance in order to work out of other businesses ( like if I wanted to bring a massage chair into an office complex's breakroom) they dont want the liability to fall on their shoulders so they require you to have insurance (which I have yet to get because frankly, I dont have much business yet...and Ive been working mostly out of spas, where I am covered under the business insurance of the establishment.)

Gifting soap would have the same liability as gifting sugar cookies at Christmas. Anyone can sue for anything at anytime. Could they win? That is a whole other ballgame and has much to do with how th judge is feeling that day. There is no difinative answer.
