Just spent an hour or so on the phone with our family attorney and he says: LEGALLY I CAN use the name because it it not registered, Trademarked or anything like that and they are only selling on Etsy. He stated that there could be hard feelings etc if I would ever decide to sell on there...

THANK YOU everyone for your replies. I went into Etsy again and googled the business name and several names came up with the name including some variations of that name....selling either similar products or different products. I do know that I WASN'T planning on selling on Etsy at all...so...
